Woman Files complaint to SP against Husband for Physical and Mental Torture

Udupi: A woman filed a complaint with the Superintendent of Police with the support of the Human Rights Protection Foundation, Udupi against her husband for extortion of money, snatching gold jewellery and physical and mental torture.

Addressing the media persons at a press meet on March 5, President, Human Rights Protection Foundation, Udupi Dr Ravindranath Shanbhag said, “Jamsheena A K the second daughter of Late Jaleel A K of Tellicherry in Kerala was married to Mohammed Sharif Ali son of Moosa Abdul Khader residing in Karamballi village Udupi on 3rd January 2013 at the Rahmaniya Juma Masjid in Doddanagudde. Right from the time the alliance was accepted, rigorous conditions were put by Jamsheena’s husband and in-laws. A dowry of at least 240 grams of gold jewellery was demanded by her in-laws and her parents had to arrange for the gold”.

Dr Ravindranath further said, “Within three-four months of the marriage, they forcibly took away all the gold ornaments worth about Rs 8 Lakhs at that time, on the pretext of buying a lorry for the transportation of fish. When she resisted parting with the gold they hit her very badly and took away the gold jewellery. Her husband never seriously engaged himself in any gainful employment. Even after buying the lorry from the money received from the sale of her gold, it was not used properly by her husband. Instead, the lorry was given for rent to some other driver. Ultimately the lorry was sold by her husband but she did not get her money or jewellery back”.

Physical assault on Jamsheena was a never-ending daily affair. On any pretext, she was being assaulted not only by her husband but also by her mother-in-law. Every day he was returning home fully drunk and then for any silly reason hitting her violently. Once they had even sent Jamsheena to her mother’s place to bring more money. Jamsheena’s mother could not arrange for money for about a month. Jamsheena’s husband insisted upon payment of at least Rs 50,000 before taking her back. Jamsheena’s mother was forced to pay the money demanded. Thus, he had collected nearly Rs 6 lakhs from her mother during the last 5 years.

In September 2014, Jamsheena’s husband got a job in the Gulf. When he went to the Gulf, Jamsheena’s mother had to arrange for his travel and other expenses. There also he did not engage himself in any gainful employment for long and returned to India within a short time. He never sent any money to her during his stay in the Gulf.

During his stay in the gulf, Jamsheena’s mother-in-law was forcing her to borrow money from whatever sources available. On August 18, 2015, Jamsheena was forced to borrow money from the Muthoot finance which she gave to his mother. While taking the loan the finance company insisted that the loan application have her husband’s signature along with Jamsheena’s. At the time of the transaction, Jamsheena’s husband was in the Gulf. And she was hopeful that the loan would not be sanctioned. Later she came to know that her husband’s signature was forged by someone else at the instance of her mother-in-law to avail the loan. Further, on November 3, 2015, she was forced by her mother-in-law to borrow another Rs 50,000 from the Fishermen Society, Malpe. On April 7, 2016, once again a loan of Rs 30,000 was taken from the Muthoot Finance in Jamsheena’s name. She had no idea whether all the loan borrowed was being repaid or not.

In June 2015, Jamsheena met with an accident in Kaup and was hospitalized at the Aadarsh Hospital in Udupi. Later, she received a compensation of Rs 35,000 from the Insurance Company. Even though she had an SB account in Vijaya Bank Tellicherry, she was forced to open another account at the Vijaya Bank in Udupi and the passbook as well as ATM card was retained by her mother-in-law. On 8 August 2016, Jamsheena’s husband returned from the Gulf. All the insurance money was taken through her ATM card by her husband.

In March 2017, Jamsheena’s maternal uncle arranged a job for Mohammed Sharif in Dubai and he sent visa to Sharif and Jamsheena. This time Jamsheena’s mother arranged funds for the travel expenses for both Sharif and Jamsheena. After spending a huge amount both returned to India within three months because Sharif worked only for a week in a supermarket and left the job.

On July 11, 2017, again he forced Jamsheena’s mother to pay him Rs 1 lakh to buy another lorry. A further loan was taken from various Finance companies since the amount was not enough to buy the lorry. Even the lorry purchased was not used for much commercial use by her husband.

When Jamsheena’s mother exhausted all her resources, Jamsheena’s husband tried another trick. On 11 April 2018, she was forced to join a group of women to borrow from Bharath Finance, since the loan was given only to Women. The money (Rs 26845) thus received was immediately withdrawn by ATM card without even informing her. Jamsheena was not even aware where the Bharath Finance office was located, what the loan amount was and the procedures to repay the loan.

Sometime in the last quarter of 2017, Jamsheena’s husband asked her to sign several blank cheques of the account with Vijaya Bank, K M Marg Udupi without informing her the purpose. She politely declined to do so since she did not know the balance in her account. Mohammed Sharif got wild and assaulted her so badly that she was forced to sign several blank cheques. She even now does not know to whom he has issued the cheques.

In mid-December 2018, Jamsheena’s husband and in-laws together assaulted her badly and threw her out of the house because she could not get more money from her mother. Jamsheena then stayed with her sister in Athrady for a week. Then one Mr Aboobacker, a senior member of the community, tried to help her and requested Jamsheena’s husband to stay separately away from his Parents along with his wife. He agreed and a small house was taken on rent in Athrady.

Once again on 12 February 2019, at 4 pm Jamsheena’s husband assaulted her. This time she did not know why she was being tortured. The same day, she escaped and went to her sister’s house. The same night at 8 pm Jamsheena’s brother-in-law gave a written complaint to the Manipal Police Station. Next day Mohammed Sharif was called to the Police Station and the police officer tried to patch up their differences. Since several issues were involved Jamsheena wanted a proper explanation for the harassment, assault and mental torture by her husband and his family. Again Jamsheena was assaulted so badly by her husband’s family, she had to undergo treatment in the District Hospital.
