Mangaluru: 9/11 form only for property Tax Collection, Should not be made Mandatory -MLA J R Lobo

Mangaluru: MLA J R Lobo held a press meet at the District congress office here on August 3.
Addressing the mediapersons Lobo said that  due to  the form 9 / 11 are the documents issued by the Gram Panchayat for non-agricultural properties in its jurisdiction as per Karnataka Panchayat Raj (Grama Panchayat Budgeting and Accounting) Rules 2006, Amendment Rules 2013 mentioned under Rule 28. GramPanchayats can issue Form 9 only for properties that are, duly converted as per the provisions under the Karnataka Land Revenue Act, 1964 by the respective Revenue Department Office and also have approved plans sanctioned as per the Town and Country Planning Act and other related enactments by the respective Urban Development Department Plan sanctioning office. For the Basava, Ambedkar and Indira Awaas Yojana Government housing scheme beneficiaries will be as per the Housing Department circular. The form-11 register is also called as Register of Demand, Collection and Balance of land and building.

He further said that the form 9 and 11 are essentially instruments for property tax collection. Gram Panchayats are local civic bodies and are authorised as per section 199 of the Karnataka Panchayat Raj Act, 1993 to collect property taxes. However the Revenue department in its circular amended in 2013 has made Form-9 and Form-11 mandatory documents for non agricultural properties coming under the jurisdiction ofGrama Panchayats for carrying out registration. Hence citizens seeking to sell their property apply for Form 9 and 11 in Gram Panchayats.

Lobo also said that due to the form 9/11 people face severe problems, the PDO’s even demand to fill the 9/11 form for getting house number for the old houses. In the 9/11 form the Panchayat Raj is dictating the terms. If any column will not be filled in the 9/11 form, the process will not be completed and the person will not be able to sell or buy the property. If the 9/11 form will not be filled the property will be declared as incomplete document.

In the Gram Panchayats to issue Form-9 the applicant should provide the documents such as, If the property is claimed to fall within the Gramthana, Gramthana sketch with the property certificate surveyed and certified by the Tahsildar. If the property is claimed to be converted property the following document copies need to be necessarily appended. Ownership documents and Conversion order issued by the Revenue dept. Ownership documents and Plan approval given by the competent authority in Urban Development Department. If the property is granted in a government Housing scheme such as; Basava Vasati, Ashraya, Indira Awas Yojana the following needs to be appended- Hakkupathra issued by the competent authority and sanction order.

We have demand to drop the 9/11 form system, because people face lot of problems, even the family property which is divided cannot be registered without the form 9/11. The RTC does not give any rights to the person, it is only to pay tax and show that the property belongs to the particular person. 9/11 form is only used for the Panchayat use. He also said that the Panchayat should not demand 9/11 form from those who have already built houses.
