Mangaluru: Upon the recommendations of competent authorities, the district magistrate had ordered that provisions of the Goonda Act be invoked against Kiran Shishila (25) of Devasya in Shishila village early this year.
It was alleged that he was involved in activities which could cause breach of public peace, harmony and security. He was arrested and lodged in Belagavi jail.
A habeas corpus petition was subsequently filed on his behalf in the state high court. Besides, the committee functioning in the high court relating to Goonda Act cases also had been requested to review the case.
It was argued on his behalf that he was a daily wage-earner and a social worker. He had the responsibility of supporting his wife, child and mother. It was also pointed out the charges against him were politically motivated.
The court upheld the arguments and ordered on Tuesday that the Goonda Act clamped on him be withdrawn.
His family sources said that they were hopeful to see him released on Wednesday.
