Udupi: Consumption of Liquor in Public Places against Law, Cautions Excise Dept

Udupi: The department of excise has cautioned that under the Excise Act, consumption of alcohol in public places was in violation of the law.

Deputy commissioner of excise G Pinto, in a notification, has said that it had come to the department's notice that private resorts, guest houses, public places and community halls in Udupi, Manipal and around were being allowed to be used for distribution and consumption of alcohol.

He has reminded that it is a punishable offence to consume alcohol in wedding halls, private guest houses, resorts or any other public places, with the exception of places having obtained official permission from the competent authority.

He has stressed that there was a provision under the law to penalize even the owners of halls or buildings who allow consumption of alcohol on their premises.

Since when wedding halls, private guest houses became public places. To enter these places for any function, you need to have an Invitation. It is not some garden, bus stop, fish market or shopping mall where anybody can visit.

Take action only if there is any nuisance created, which can happen even in permitted bars and hotels.

Introducing some law without looking at the practical purpose not going to help anybody and it defeats the purpose. So, use your brains first and act.

Scenario one- In-flight Alcoholic drinks , Where very few passengers drink and others feel uncomfortable . Is it not a public place ?

Scenario two- private party and entry by invitation – drinking at will becomes an offence ?.

Scenario three- already drunk in a permitted place and loaded with a potential to harm the public and family.

Which is more prohibitable ? Isnt it Demonocratic hypocrisy ?

It looks like someone is giving their own interpretation of "Public Place". There is no way private building such as roof-tops of apartment complex a public place. Public places are mostly commercial establishments or establishments run by the government and government bodies. Ex: Office of the Excise Department is the public place and it is doubtful that no one is drinking there the siezed liquor!

When the government itself is encouraging people to drink and set a target for the revenue, does it matter where you drink? The hall owners should decide wheather or not drinking is allowed during the wedding parties.

Officers are looking for avenues to make money.

If private guest houses are public places, it is but proper that 'public places' are defined. Law should benefit people and if it is burdensome, it should be abolished.

First define public places. T,V.Serials,movies or private places. Hide in a dark place like during British time..Even today Mangaloreans specially in villages got the habit of gulping liquor instead of enjoying it by sipping. The fear of getting arrested at that time when prohibition was there.
Even Mangaloreans use toddy for fermentation along with black gram and fetch today from 1/2 litre toddy tappers was so fearsome.
Today Govt wants money and collects good amount by excise duty and tell people to hide and drink and sell the liquor in shops the public place.This is govt hypocracy.
