Rahul Gandhi may have ot face trial in defamantion case: SC

New Delhi, July 19 (IANS) The Supreme Court on Tuesday indicated that Congress Vice President Rahul Gandhi would have to face trial in a defamation case filed by an RSS activist for allegedly accusing the organisation for assassination of Mahatma Gandhi.

“You can’t make collective denunciation of an organisation,” an apex court bench headed by Justice Dipak Misra said, adding that the case may be decided on merits whether Rahul Gandhi’s charge was for public good or not.

The Congress Vice President has so far maintained that his statement blaming the RSS was based on the judgement of a high court and on the basis of certain documents.

The court observed that the statement was arguably made on the basis of a high court judgement but the case must be decided on merits.

RSS activist Rajesh Kunte had filed the defamation suit in a Maharashtra court against Gandhi. The Congress Vice President then moved the Supreme Court for quashing of the defamation proceedings.

Hearing Gandhi’s plea, the apex court told Kunte that the purpose of the defamation law was not to promote litigation.

Adjourning the matter till July 27, the Supreme Court asked the Congress Vice President to detail his arguments.

Senior counsel Kapil Sibal will appear for Rahul Gandhi in the case.

    Gopal Godse, Nathuram’s younger brother who was also one of the co-conspirators, would later write many books about the assassination and the motivation behind it.

    Arvind Rajagopal examined some of what Gopal said in an article in Frontline in 1994 (later published in Beyond Doubt: A Dossier on Gandhi’s Assassination).

    [Nathuram’s] statement at the murder trial (originally published in 1977, in a volume entitled May It Please Your Honour) says, “I am one of those volunteers who joined the Sangha in its initial stage” (p. 142). He says he left it to do more directly political work in the Hindu Mahasabha (he does not say when). But his brother Gopal Godse suggests that he never really left the RSS, and that the statement at his trial was meant to alleviate the pressure on the Sangh, which was banned following Gandhiji’s murder. A leader of the Hindu Mahasabha, Shyama Prasad Mookherjee, went on to found the Jana Sangh, forerunner of the BJP.

    Gopal Godse was also interviewed on camera, months before his death in 2005, detailing the three attempts to assassinate the Mahatma.

  2. This is exactly why Regressive Congress Party is a danger to democracy. I don’t mind if a political leader tries to be critical of anti-democratic, anti-secular forces. But, he/she can not do it selectively. Look how Congress Leaders in an attempt to appease minority groups by bring up an incident from 1948 and try to put blame RSS (code word for Hindu groups). Have you seen this character say anything about the terrorist attacks and those behing it? I’ve listed a few incidents from July alone!!!

    – July 3rd – Iraq suicide bomb – 320 dead
    – July 1st – Dhaka attacks – 25 dead

    Again, tell me if there was any criticism against those behind all these attacks by any Congress leader?

  3. Read the following and see if you see any hypocrisy.

    One group (RSS) has clearly distanced itself from Mahatma Gandhi Assassination. In fact, Godse himself had left the organization before the tragedy. Still, our dishonest, regressive groups and political leaders continue to put blame on RSS.

    On the other hand, day after day, some people carry out deadly attacks on innocent civilians and openly claim responsibility. But, our secular groups and media argue that these attacks have nothing to do with religion!!!!!! In other words, the open testimony by terrorists and their organizations are not to be believed!!!! LOL

    If you still don’t see the height of hypocrisy, you are clearly a religious bigot who hates all Hindus. That’s the sad truth!!!
