Bengaluru: A single-judge bench of Justice R B Budihal on Thursday turned down an appeal filed by Karthik Gowda, son of Union minister of law D V Sadananda Gowda, to quash a case of sexual assault and cheating filed against him by actor-model Mythriya Gowda.
The judge cited a supreme court guideline that no case should be dropped in the initial stages when grave charges like sexual assault and cheating were involved. The bench said that the advocates of the appellant (Karthik) had stated that prima facie it was not evident that there was sexual assault.
But going by the factual and circumstantial evidence, the argument did not hold good. The advocate for Karthik had not provided the court with reasons for dropping of the charges. Hence the case could not be quashed, the judge said.
Mythriya had alleged that Karthik had married her in secret but by getting engaged to another girl he had cheated on her. Besides, on promise of getting married to her (Mythriya0 he had taken physical advantage of her.
