Grand Daughter Tricks Grand Mother in Land Deal and Disappears

Udupi: Ex-serviceman Lawrence D’Souza came with a complaint before the Human Rights Protection Foundation, Udupi about a woman, Roshni Umakanth Poojary, aged about 28 years tricking her 84-year-old grandmother Celestial Andrade, a resident of Santur village, Mangaluru Taluk and also her father Ronald D’Souza and enriching herself with the agricultural property of Two Acres and Five Cents.

Addressing a press meet on October 6 Dr Ravindranath Shanbhag, President of Human Rights Protection Foundation said that, Celestin Andrade a widow aged about 84 years, whose husband Gregory D’Souza expired a few years back lives in Santur village, Mangaluru Taluk.

Property of Celestin Andrade

Celestin Andrade had purchased an immovable property of Two Acres and Five cents now worth Rupees several Lakhs, in Santur village in her name out of her earnings in the year 1967. With the help of her husband Gregory D’Souza, she had developed the property, dug a deep open well and had also constructed a house in the same land. Celestial is the mother of four children who are now living separately. Celestial’s husband, Gregory D’Souza, had died a few years back. Unable to live all alone, she had requested her elder son Donald D’Souza to come back from Mumbai and stay with her along with his family.

Who is Roshni Umakanth Poojary?

Roshni Umakanth Poojary is the daughter of Donald D’Souza and is married to Umakanth Poojary about ten years back. While Umakanth Poojary went to Dubai for work, Roshni stayed back at her maternal house. Roshni used to visit Celestial Andrade’s house frequently and had developed close acquaintance with her grandmother. Celestial Andrade was also very affectionate to Roshni as she was the daughter of her eldest son and was showing a lot of concern towards her.

WILL by Celestin Andrade

On September 9, 2018, Celestin Andrade made her WILL distributing her immovable agricultural property of Two Acres and Five Cents including the house, worth several Lakhs amongst her four sons. All were happy with the WILL which was then registered in the office of the Sub-Registrar, Mulki, Dakshina Kannada district.

Shocked and struck with Paralysis

About twenty days back the officials of village panchayat came to Celestin Andrade’s house for a survey made under an Agricultural Scheme initiated by the Government of Karnataka. During the enquiry under the said scheme, Celestin Andrade came to know that her immovable property of Two Acres and Five Cents along with the house was currently in the name of Roshni Umakanth Poojary. Since more details were not given by the officials who had visited her house, Celestial was shocked and left in utter confusion and was immediately struck with Paralysis. Presently Celestial is undergoing treatment for the same.

Celestin Andrade and her four children together tried to solve the mystery and in the process were able to recollect certain incidents which resulted in the current developments.

How Roshni Umakanth Poojary cheated?

As Roshni Umakanth Poojary was in close touch with her grandmother Celestin Andrade, she knew all the developments with regard to the disposal of property through WILL dated 09.11.2018. Knowing well that both her father Ronald D’Souza and Celestial Andrade were illiterate, she took them to the office of the Sub-Registrar, Mulki in January 2019 and got certain documents signed by both Celestial Andrade and Ronald D’Souza under the pretext that their signatures have been taken for enlisting their names in certain Government-sponsored Agricultural loan scheme. As Celestin Andrade and Ronald D’Souza had no reason to doubt Roshni, they signed the documents wherever required. After this, a few months later, Roshni Umakanth Poojary had taken her father Ronald D’Souza to the sub-registrar office and got him signed certain documents. Again, Ronald D’Souza signed the documents wherever required without suspecting his daughter of foul play.

What had happened?

In the first instance, Roshni Umakanth Poojary caused the immovable property of 2.5 acres along with the house through GIFT deed signed and executed by Celestin Andrade in favour of Ronald D’Souza.

In the second instance, Roshni Umakanth Poojary caused the immovable property of 2.5 acres along with the house through GIFT deed signed and executed by Ronald D’Souza in her favour. Thus, the entire immovable property of 2.5 acres along with the house belonging to Celestial Andrade was transferred in the name of Roshni Umakanth Poojary without the knowledge of both Celestin Andrade and Ronald D’Souza.

Human Rights Protection Foundation, Udupi

Human Rights Protection Foundation after going through the complaint given by Ex-serviceman Lawrence D’Souza, ascertained that Roshni Umakanth Poojary had duped senior citizen Celestin Andrade aged about 84 years.

The Human Rights Protection Foundation is now exploring ways to get justice to Celestin lawfully. They are also exploring possibilities of filing a case under “THE MAINTENANCE AND WELFARE OF PARENTS AND SENIOR CITIZENS ACT, 2007” to get justice to Celestin Andrade.
