Udupi: Justice Served: 82-year-old Stella Gets back her Land

Udupi: Truth has prevailed again, the Assistant Deputy Commissioner, Mangaluru Sub-Division reviewing the petition filed by an elderly woman over execution of sale deed in fraudulent manner by her relatives, has declared it null and void, said Dr Ravindranath Shabouge, President Human Rights Protection Foundation, Udupi.

Stella D’Souza (82), a retired teacher resident of Vamanjuru Mangaluru had filed a petition with the Assistant Commissioner, Mangaluru Sub-Division over her relative Juliana D’Souza who by fraudulent means executed the sale deed of Stella’s property in her name. Juliana used to visit Stella’s house often and persuade her to keep her land records safe in the Sub-Registrars office.

Juliana misguiding Stella convinced her sign the sale deed executed in the sub-registrar office. Stella who was unaware of the execution of the sale deed believed that the papers she was signing were the agreement papers to keep her land records safe in the sub-registrar’s office. She later came to know that she was tricked by Juliana. Stella filed a petition in the JMFC, 3rd Court Seeking Justice.

Stella who later came to know about the functioning of Human Rights Protection Foundation, Udupi in the cases relating to senior citizens approached them. The foundation filed a petition with the Assistant Commissioner, Mangaluru Sub-Division seeking to declare the sale deed executed in the favor of Juliana as null and void.

The Additional Commissioner reviewing the petition found there was no endorsement written by the sub-register on payment of money amounting rupees 3.3 lakhs for the purchase of 5 cents land as claimed by Juliana. While Juliana was cross questioned on the same she failed to produce related evidence claiming that she had paid money to Stella. Assistant Commissioner then passed an order declaring the sale deed null and void.

Stella said that truth has finally prevailed and she is happy with the order of the Assistant Commissioner.
